Building Safety Law F.S. 553.899
The Champlain Tower collapse (Surfside, Fl.) claimed 98 lives. F.S. 553.899 requires Inspections of condominiums (3 story or more and older than 30 years). The building must have a phase 1 inspection. F.S. 718.112 requires cash reserves be set aside for maintenance and repairs.
Structural Integrity Reserve Law FS 718.112(G)
The amended condominium laws require a structural integrity reserve study every 10 years. The first study must be done by December 31, 2024.
Engineers can determine structural component life expectancy. Go to the source and don't pay a middle man for public adjuster data, or prices set by a dominant contractor, which may not be specific enough for your building. Our reserve studies use a proprietary cost trend analysis tool to estimate reserves. Structural integrity reserves can only be used for the building components listed in the SIRS. Don't get stuck with a big number set by a contractor who wants to escalate future costs.
Inspection Phase?
Get a phase 1 inspection first
Some contractors will say your building has major issues and want to skip to a phase 2 before the phase 1 inspection. The report they provide is often a bid for repairs instead of a report which analyzes the whole building. A phase 1 is required by the law and is used to determine if a phase 2 study if its needed. Don't skip this statutary requirement.
A phase 2 finding implies a building structure is 20% compromised and could result in condemnation or closure of your building!
It's hard to find someone you can trust.
Our inspection plan scores defects based upon severity. We try to avoid a phase 2 inspection finding and record backup data to justify the rating we give a building. Don't believe someone who says all condos need a phase 2 inspection without phase 1.
